			<content:encoded><![CDATA[<p>On Tuesday Colorado Governor Bill Ritter signed legislation that requires jail sentences for those that are convicted of more than one drinking and driving offense.  He also signed a bill that reduces jail time for several different drug offenses.  I think the net outcome of this bill will be MORE people in jail.<br />
First, the DUI measure (as the mainstream press refers to it) will put more people that live in Colorado in jail.  DUI is a very bad term to use.  The bill jails people for DWAI offenses as well as DUI offenses.   If a Coloradoan is convicted of two DWAIs, this legislation sends that person to jail for ten days.  A Coloradoan can now spend ten days in jail for as few as two beers.  The current BAC limit for DWAI is .05%.  For many people, that equates to one beer with strong alcohol content. Get caught driving two times after having a Breckenridge Christmas Ale and you will now spend ten days in county.<br />
The current alcohol BAC levels in Colorado are unreasonably low.  DUI is now set to .08% BAC and DWAI is at .05% BAC.  (For those under 21 years of age it is .02&#038; BAC!)  That is about half of what the levels were 20 years ago when the DUI level was .15% BAC.  The .15% BAC was a reasonable level.  At .15% I would agree that a person should not be driving.  The .05% BAC is an unreasonably low limit.  Under the new legislation, two-time .05% BAC offenders will be put in jail for having a little wine with their spouse over dinner—twice.<br />
We were all on board with the “getting the drunks off the roads” campaign 20 years ago.  And I am still on board with that today.  Drunks need to be taken of the roads and we need to give the police the means by which to remove them from the roads.  As Governor of Colorado, I will advocate a change to the DWAI laws that will return Colorado to the more reasonable level of .15% BAC.  Furthermore, I will pardon anyone that was convicted of a driving while drinking offence where the level was below .15% BAC.  I will REDUCE the number of people in jails in Colorado.<br />
An important note here with regard to this bill is that those convicted of their FIRST offense of either DUI or DWAI will now sit in a Colorado jail for two days.<br />
With regard to the lessened jail sentences for drug offenders, I say that this law will STILL put more people in Colorado in jails.  This bill carries a bunch of “treatment” clauses that the government of Colorado can use as a very big sticks—jail –if the “user” does not comply.  The government should NOT be in the business of “treatment” ever.  First, it is not a legitimate function of government and second, the government does a very poor job in that function and that is exactly why it is not supposed to be a legitimate function of government in the first place.  There are a plethora of private organizations in Colorado that are willing, and much better equipped, to provide assistance to those that need—and want—“treatment.”  There are church organizations—thousands—, there is Step 13, there are 12 step programs, there is the United Way, and there is family.  ANY of these privately funded organizations are much better equipped to help a person that is in need of treatment than the government is.<br />
The PRIMARY function of government in the United States, and in Colorado, is to protect individual rights.  That means that if someone gets killed, say JonBenét Ramsey, then the government goes after the perpetrator with all its power to make sure that that person is punished—goes to jail for a VERY long time—in the presence of the public so that any other person that might be thinking of the same kind of crime will have second thoughts and, hopefully, not violate another person’s individual rights.  This primary function is to prevent violations by example—jail.  “Treatment” is NOT a part of the government’s legitimate function, punishment is.  If we, here in Colorado, the Boulder police and Colorado—Governor Ritter—find that guy that broke into a private home in Boulder, and murdered that six-year-old baby girl, I want to see that guy spend the rest of his life in a broom closet—jail.  I do not want to see him in “treatment” and I am sure that Jon Benét’s father does not either.  (FYI: I AM against the death penalty for several reasons that I will not go into here.)<br />
For the state of Colorado to get more into the “treatment” program will only create more wards of the state.  That is a bad idea.  What about repeat speeders?  Should they get “treatment?”  (They already do.)  What about people that do not water on the “allowed days?”  Treatment?  I think not.  “Treatment” for the government is nothing more than social engineering.  You do not go to jail but the government tells you how to act based on what THEY think is proper, and, if you fail, JAIL.  This is a VERY bad idea.  Government is NOT supposed to set the standards for society—the government just keeps my neighbor from raping my wife (so I hope).  We, the People, set the standards.  We, The People, are supposed to lead, not government.  It cannot and do not expect it to.<br />
Colorado Governor Ritter: Don’t put the resources—money—of  Colorado into throwing me in jail for having a glass of wine with my beautiful wife at dinner.  Spend MY cash on finding that SOB that broke into JonBenét’s PRIVATE home and murdered her.  Stand up for REAL victims of crime.  How much have you spent on finding that murder?  I’ll send a CORA request later.<br />
Boulder Police:  You spent how much on putting two SWAT teams on the hill last year to bust people that might run naked through the streets.  You spend how much on jacking up a bunch of college students on the University of Colorado campus that want to drink beer.  How much did you spend on finding the killer of JonBenét?  CORA coming. . . get on the case.<br />
The government is supposed to protect the rights of individuals.  That is why we have a criminal justice system in the first place.  If a person in Colorado runs a stop sign and kills a six year old then I could care less if that person was drinking or changing the stations on their radio.  I want jail time!  If a drug user breaks into a home to steal for his drug habit or another person breaks into a home to steal to buy a car.  I want that person to see jail.  NO TREATMENT!  NO JAIL FOR VICTIMLESS CRIME!<br />

Colorado Governor Ritter is that kind of idiot.
Ritter signed the nine (9) bills on Wednesday, February 24th, 2010 that take effect Monday, March 1st, 2010.  That gives businesses Thursday and Friday (and Saturday and Sunday, if they can afford to pay overtime to their employees) to figure out (with a bunch of lawyers) and implement (with business and IT) the sweeping tax changes before they send out their invoices on the 1st.
